The Act was created in 2004.
It protects mortgagors by placing limits on interest rates
after default, prohibiting balloon payments, placing restrictions
on the arbitration clause, and placing limitations on refinancing,
among other things.
Foreclosure
Foreclosure in Utah is non-judicial. The statutes were modeled after California’s, and
were put in place in 1961. Foreclosure is completed in four and one half months. The foreclosing auction is advertised in the county paper
once a week for three weeks prior to the auction. A notice is posted
on the property twenty days before it is to be sold. The property
is auctioned, and the highest bidder wins it. The winning bidder at a foreclosure auction must pay $5000
down, and the rest within 24 hours.
